We inform you here about the collection and use of personal data on our website in compliance with German data protection law. This statement is available at any time. Please note that data transmission over the Internet (e.g., via email) may be subject to security gaps. The use of our contact information for advertising purposes is prohibited without prior written consent. All persons named hereby object to any commercial use or disclosure of their data.

Definitions

This privacy policy is based on the definitions used by the European legislator for the adoption of the GDPR (Article 4 GDPR). This privacy policy is intended to be both easy to read and understand for everyone. To ensure this, we would first like to explain the terms used. Among other things, the following definitions are used in this privacy policy:

  • ‘Personal data’ means any information relating to an identified or identifiable natural person (hereinafter ‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

  • ‘processing’ means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;

  • ‘restriction of processing’ means the marking of stored personal data with the aim of limiting their future processing;

  • ‘profiling’ means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements;

  • ‘controller’ means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law;

  • 'recipient' means a natural or legal person, public authority, agency or other body to which personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be considered recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules and in accordance with the purposes of the processing;

  • ‘third party’ means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons authorised to process personal data under the direct authority of the controller or processor;

  • “Consent” of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

Data Subject Rights

 

You have the right to:

  • Request information pursuant to Art. 15 GDPR about your personal data processed by us. In particular, you may obtain information on the purposes of processing, the categories of personal data, the categories of recipients to whom your data have been or will be disclosed, the envisaged storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the source of your data if they were not collected by us, and the existence of automated decision-making including profiling and, where applicable, meaningful information about the details involved;

  • Request rectification without undue delay pursuant to Art. 16 GDPR of inaccurate personal data concerning you stored by us or completion of incomplete data;

  • Request erasure pursuant to Art. 17 GDPR of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims;

  • Request restriction of processing pursuant to Art. 18 GDPR where the accuracy of the data is contested by you, the processing is unlawful but you oppose erasure and we no longer need the data, yet you require them for the establishment, exercise or defence of legal claims, or you have objected to processing pursuant to Art. 21 GDPR;

  • Receive your personal data in a structured, commonly used and machine-readable format pursuant to Art. 20 GDPR and have those data transmitted to another controller;

  • Withdraw consent at any time pursuant to Art. 7(3) GDPR with effect for the future. This means we may no longer continue the data processing that was based on this consent; and

  • Lodge a complaint pursuant to Art. 77 GDPR with a supervisory authority. As a rule, you may contact the supervisory authority of your habitual residence, place of work or our company’s registered office.

Right to Object

Where your personal data are processed on the basis of legitimate interests pursuant to Art. 6(1)(f) GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR on grounds relating to your particular situation, or where the objection is to direct marketing. In the latter case, you have a general right to object which we will implement without the need to state a particular situation.


SSL Encryption

For security reasons and to protect the transmission of confidential content—such as enquiries you send to us as the site operator—this site uses SSL encryption. You can recognize an encrypted connection by the browser’s address line switching from “http://” to “https://” and by the lock icon in your browser bar. When SSL encryption is activated, the data you transmit to us cannot be read by third parties.

Server Log Files

You can generally use our website without disclosing your identity. When you access our website, the browser used on your device automatically sends information to our website’s server. This information is temporarily stored in a so-called log file.

The following information is collected without your intervention and stored until it is automatically deleted:

  • IP address of the requesting computer,

  • date and time of access,

  • name and URL of the retrieved file,

  • website from which access is made (referrer URL),

  • browser used and, where applicable, your computer’s operating system and the name of your access provider.

We process these data for the following purposes:

  • ensuring a smooth connection to the website,

  • ensuring comfortable use of our website,

  • evaluating system security and stability, and

  • for further administrative purposes.

The legal basis for data processing is Art. 6(1)(f) GDPR. Our legitimate interest follows from the purposes listed above. Under no circumstances do we use the collected data to draw conclusions about your person. In addition, we use cookies and analytics services when you visit our website.
 

Personal Data

The website is operated by Swiss Orange. Our website is currently designed to inform interested users as effectively and individually as possible about relevant topics, our services and our offers. For this purpose, anonymous data are collected and user profiles are created. Swiss Orange reserves the right to store information (“cookies”) on the user’s computer system that is technically necessary to maintain the website’s functionality. The provision of personal data is voluntary and serves to expand and maintain our business relationship, including but not limited to contacting interested parties with new information, offers and products as well as other marketing activities. Your personal data are processed by Swiss Orange in compliance with the applicable laws. Storage takes place on distributed data systems and may occur in any location worldwide.

Comment Functions

In the context of the comment function, we collect personal data (e.g., name, email) provided by you when commenting on a post only to the extent you have communicated them to us. When a comment is published, the email address you provide is stored but not published. Your name is published unless you have written under a pseudonym. This processing is based on our legitimate interest in offering users a means of expressing their opinions.
 

Privacy Notice for HubSpot
 

We use HubSpot on our website for marketing activities. HubSpot is a US software company with a subsidiary HubSpot Ireland Limited, 2nd Floor, 30 North Wall Quay, Dublin 1, Ireland. We use this integrated software solution for our own marketing, lead generation and customer service. This includes, among other things, email marketing (sending newsletters and automated mailings), social media publishing and reporting, contact management such as user segmentation and CRM, landing pages and contact forms.

HubSpot uses cookies—small text files stored locally in your browser cache on your device—which enable us to analyse your use of the website. The information collected (e.g., IP address, geographic location, browser type, duration of visit and pages viewed) is evaluated by HubSpot on our behalf so we can generate reports on visits and pages viewed.

Information captured via HubSpot and our website content is stored on servers of HubSpot’s service providers. Where you have given consent pursuant to Art. 6(1)(a) GDPR, processing on this website for the purpose of website analytics is carried out on that basis.

As personal data may be transferred to the USA, additional safeguards are required to ensure the GDPR level of data protection. To ensure this, we have concluded Standard Contractual Clauses pursuant to Art. 46(2)(c) GDPR with the provider. These oblige the recipient in the USA to process the data in accordance with the protection level in Europe. In cases where this cannot be ensured even by this contractual extension, we seek additional arrangements and assurances from the US recipient.

The data are deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. You can permanently object to the collection of data by HubSpot and the setting of cookies by preventing the storage of cookies via your browser settings. You may object to the processing of your personal data at any time with effect for the future.

Privacy Policy for the Google Analytics Web Analytics Service


For the purpose of demand-oriented design and continuous optimization of our pages, we use Google Analytics, a web analytics service of Google Inc. (https://www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). In this context, pseudonymized usage profiles are created and cookies (see section 5) are used. The information generated by the cookie about your use of this website, such as:

  • browser type/version,

  • referrer URL (the previously visited page),

  • host name of the accessing computer (IP address),

  • time of the server request,

is transmitted to a Google server in the USA and stored there. The information is used to evaluate the use of the website, compile reports on website activities and provide other services related to website and internet usage for the purposes of market research and the demand-oriented design of these internet pages. This information may also be transferred to third parties where required by law or where such third parties process these data on our behalf. Your IP address will not be merged with other Google data. IP addresses are anonymized so that assignment is not possible (IP masking).

You can prevent the installation of cookies by selecting the appropriate settings in your browser software; however, please note that in this case you may not be able to use all functions of our website to their full extent.

You can also prevent the collection of data generated by the cookie and relating to your use of the website (including your IP address) and the processing of these data by Google by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=de).

As an alternative to the browser add-on, especially for browsers on mobile devices, you can also prevent collection by Google Analytics by clicking the aforementioned link. Privacy Policy for Google Ads Conversion Tracking

This website uses the “Google AdWords Conversion Tracking” function of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”). Google AdWords Conversion Tracking uses “cookies”, text files stored on your computer that enable analysis of website usage if you clicked on a Google ad. The cookies are valid for a maximum of 90 days. No personal data are stored. Our website integrates plugins of the microblogging network of Twitter Inc. (“Twitter”). You can recognize Twitter plugins (tweet button) by the Twitter logo on our site. An overview of tweet buttons can be found at: https://dev.x.com/web/tweet-button

When you visit a page of our website that contains such a plugin, a direct connection is established between your browser and the Twitter server. Twitter thereby receives information that you have visited our site with your IP address. Facebook Plugins

Our website uses social media plugins from Facebook to make use more personal. For this we use the “LIKE” and “SHARE” buttons. This is an offering from Facebook.

When you access a page on our website that contains such a plugin, your browser establishes a direct connection to Facebook’s servers. The content of the plugin is transmitted by Facebook directly to your browser and integrated into the website. Through this integration, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.

Salesforce

This website uses the Marketing Cloud Personalization tool (formerly Evergage) from Salesforce for personalization. Based on website actions (e.g., clicks, dwell time, search terms entered), it enables us to display personalized content and better understand the needs of our website visitors. For example, we can show you products you might like or send you an email notification.

We pass the collected data to the respective internal departments or to service providers as required. The primary service provider is salesforce.com Germany GmbH, Erika-Mann-Straße 31–37, Kontorhaus, 80636 Munich, Germany. Platform/hosting service providers may gain access to personal data from a third country (countries outside the European Economic Area). Standard Contractual Clauses pursuant to Art. 46 GDPR have been concluded with these service providers as appropriate safeguards. LinkedIn

Our website uses functions of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. This website uses the Google Maps mapping service via an API. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

To ensure data protection on this website, Google Maps is deactivated when you first enter this website. A direct connection to Google’s servers is established only when you activate Google Maps yourself (consent under Art. 6(1)(a) GDPR). Activation occurs when you agree in the privacy settings of the consent banner that external media may be used. In this way, your data are not transmitted to Google when you first enter the site.

After activation, Google Maps will store your IP address. This is then usually transferred to a Google server in the USA and stored there. After activation of Google Maps, the provider of this site has no influence on this data transfer.

This website embeds videos from YouTube. The operator is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

To ensure data protection on this website, YouTube videos are deactivated when you first use this website. A direct connection to YouTube’s servers is established only when you activate YouTube videos yourself (consent under Art. 6(1)(a) GDPR). Activation occurs when you agree in the consent banner that external media may be used, or when you individually activate a YouTube video by clicking a video placeholder. This prevents your data from being transmitted to YouTube upon your first visit.

We also use YouTube in enhanced privacy mode. According to YouTube, this mode ensures that YouTube does not store information about visitors to this website before they watch the video. However, transmission of data to YouTube partners is not necessarily excluded by the enhanced privacy mode. Thus, YouTube establishes a connection to the Google DoubleClick network regardless of whether you watch a video.

When YouTube videos are activated, a connection to YouTube’s servers is established as soon as you start a YouTube video on this website. The YouTube server is informed which of our pages you have visited. If you are logged in to your YouTube account, you enable YouTube to directly associate your browsing behaviour with your personal profile. You can prevent this by logging out of your YouTube account.

If you have any questions, we offer you the opportunity to contact us via a form provided on our website. A valid email address is required so that we know who the enquiry is from and can answer it. The personal data we collect for the use of the contact form will be automatically deleted after your enquiry has been dealt with.

Newsletter Data

If you wish to receive the newsletter offered on the website, we require an email address from you and information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. No further data are collected. We use these data exclusively for sending the requested information and do not pass them on to third parties. You can revoke the consent given to store the data, the email address and their use for sending the newsletter at any time, for example via the “unsubscribe” link in the newsletter.

Processing for the purpose of sending the newsletter is carried out pursuant to Art. 6(1)(a) GDPR on the basis of your voluntarily granted consent, which you may revoke at any time with effect for the future.

Disclosure of Data

We only disclose your personal data to third parties if:

  • you have given your express consent pursuant to Art. 6(1)(a) GDPR,

  • disclosure is necessary pursuant to Art. 6(1)(f) GDPR for the establishment, exercise or defence of legal claims and there is no reason to assume that you have an overriding legitimate interest in not disclosing your data,

  • there is a legal obligation to disclose pursuant to Art. 6(1)(c) GDPR, or

  • this is legally permissible and necessary pursuant to Art. 6(1)(b) GDPR for the performance of a contract with you.

Links to Third-Party Websites

The links published on our website are researched and compiled with the greatest possible care. However, we have no influence on the current and future design and content of the linked pages. We are not responsible for the content of the linked pages and expressly do not adopt their content as our own.
